Terms of Service
Effective Date: October 24, 2026
1. Agreement
These Terms of Service (the "Terms") are an agreement between you and Gambit Gamer, Inc. ("Gambit Gamer," "we," "us"). By creating an account or using Gambit Gamer, you accept these Terms.
The Season Competition is governed by the Official Rules. For Competition-specific matters, the Official Rules control if they directly conflict with these Terms.
2. The Platform
Gambit Gamer is a free-to-play skill platform. Threaders make predictions ("gambits") on the live performance of featured streamers — Gambit Performance Units ("GPUs") — matched player-to-player and scored by a published rating method.
There is nothing to buy to play, and nothing you can buy improves your competitive standing.
3. Your Account
You must be at least 18 years old to create an account.
One person, one account. You are responsible for your account and for keeping your credentials secure.
Information you provide must be accurate. We may require verification of age, identity, phone number, or eligibility.
One phone number may be associated with only one account. Virtual, VOIP, or forwarding numbers may be rejected during verification.
We may suspend or restrict accounts during any investigation under Section 9.
Beware of impersonation. Official Gambit Gamer email comes only from addresses on the @gambitgamer.com domain, and official accounts and channels are verified through gambitgamer.com. We will never ask you by unsolicited direct message for your password, credentials, or one-time verification codes. Do not send money, codes, or credentials to anyone claiming to represent Gambit Gamer unless you have independently verified the communication. Report suspicious contact to support@gambitgamer.com.
4. GGS, GGX, and Virtual Items
GGS, GGX, Cache, titles, and all other virtual items or ratings:
- have no monetary value;
- are not your property;
- cannot be purchased, sold, transferred, or redeemed for cash; and
- may reset, expire, or change as described in the Official Rules and published Season parameters.
You receive a limited, revocable license to use virtual items within Gambit Gamer, nothing more.
5. Cache and the Gambit Shop
Cache items are cosmetic collectibles. They are display-only and never affect gameplay, ratings, Class eligibility, drawing entries, or odds of winning.
Cache is acquired by earning (titles, honors, Champion awards) or with GGS through the Gambit Shop after meeting the published activity requirement.
Cache is non-transferable and cannot be traded, sold, or redeemed. Because Cache is obtained with free seasonal points, Cache acquisitions are not refundable.
Limited Cache items that sell out remain visible as sold out. After using a 1UP, access to premium Cache tiers may be limited for the remainder of the Season, as published.
6. Competition
Seasons, GGS, GGX, Classes, drawings, prizes, and claims are governed by the Official Rules and the published Season parameters. Read them — they are short and they control.
7. Prize Fulfillment
Prizes ship only after the claim process in the Official Rules is complete, including phone verification.
Shipments use tracked delivery to the address provided at claim. Signature confirmation may be required. Carrier-confirmed delivery to that address completes our fulfillment obligation. If a shipment is lost in transit without a delivery scan, we will pursue a carrier claim and provide one re-fulfillment.
Winners are responsible for applicable taxes. Where tax documentation is required by law, it is collected securely; Gambit Gamer does not store Social Security numbers.
Prizes and tax reporting. Prizes are awarded at the fair market value Gambit Gamer assigns to them on the date of the award, and that value is recorded. Where the total value of prizes awarded to you in a calendar year reaches the threshold at which United States tax law requires us to report prize income, we will ask you for a completed IRS Form W-9 before any further prize is fulfilled, and we will issue you the corresponding information return (currently Form 1099-MISC) for that year. You are responsible for any taxes on prizes you receive. A prize that is not claimed, or for which a requested tax form is not provided within 30 days of our request, may be forfeited and awarded to an alternate under the Official Rules. See also Official Rules §16 (Prize Claims).
8. Merchandise and Commercial Content
Any merchandise we sell is a separate retail transaction. Merchandise purchases never affect GGS, GGX, Class eligibility, drawing entries, or odds of winning, and are governed by the purchase terms presented at sale.
Gambit Gamer may receive compensation from sponsors, advertisers, affiliate programs, brands, fundraising partners, or other commercial partners. Sponsored or commercial content will be identified where appropriate, and never affects competitive outcomes, ratings, eligibility, drawing entries, or odds of winning.
9. Conduct
Collaboration is allowed. Manipulation is not.
Freedom of Participation. Gambit Gamer is built for broad user freedom. Threaders may communicate, strategize, collaborate, criticize, joke, compete, express themselves, and participate as they choose, provided their conduct is lawful and does not manipulate the Competition, compromise platform security, impersonate others, violate another person’s privacy, harass or threaten others, evade enforcement, or otherwise violate these Terms. Maximum user freedom, minimum necessary restrictions.
This section defines what you may and may not do. Except for the zero-tolerance rule in 9.4, enforcement consequences are described in Section 13 and the Official Rules.
9.1 One Person, One Account
One person may create, control, and use only one Threader account. You may not allow another person to use your account. Buying, selling, renting, lending, transferring, or otherwise assigning an account is prohibited, as is creating or using alternate accounts to evade enforcement. Bot or automated accounts are prohibited unless expressly authorized in writing by Gambit Gamer, Inc.
9.2 Collaboration Is Allowed
Threaders may freely discuss gameplay, analyze GPUs and matches, share opinions, discuss their gambits, and collaborate on strategy. Talking, strategizing, and helping other Threaders decide how to thread is normal play — it is not collusion by itself.
9.3 Manipulation Is Prohibited
You may not engage in intentional conduct designed to manipulate, distort, manufacture, or improperly influence Gambit Gamer systems or results, including matching, resolution, scoring, GGX, GGS, transfers, qualifying activity, Leaderboard or Class standing, drawing eligibility, drawing entries, Competition results, or any other Gambit Gamer competitive system.
You may not coordinate with a GPU or any other person to intentionally and improperly influence an underlying gameplay result for the purpose of affecting Gambit Gamer activity.
9.4 Zero Tolerance for Intentional Manipulation
Intentional manipulation of underlying gameplay or Gambit Gamer competitive systems is a zero-tolerance violation. This applies to Threaders, GPUs, employees, contractors, personnel, and any other participant involved with Gambit Gamer.
If we confirm that a person intentionally participated in, attempted, directed, assisted, facilitated, or colluded in such manipulation, the consequence is a permanent, person-level ban: permanent exclusion from participation in Gambit Gamer, Inc.’s platform and services. The ban applies to the person, not merely the account involved.
A permanently banned person may not: create, maintain, control, or use a Gambit Gamer account; participate as a Threader or in gambits; serve, participate, or return as a GPU; participate in any Gambit Gamer Competition, competitive feature, prize program, promotion, or event; receive Competition prizes or benefits; create or use another or alternate account; use another person’s account; direct another person to participate on their behalf; or otherwise circumvent the ban. Ban evasion is itself prohibited.
9.5 Investigation and Appeal
A suspicion or accusation alone does not create a permanent ban. We may temporarily suspend or restrict access, or preserve an account or affected activity, while we investigate. Permanent zero-tolerance removal follows only after we determine that sufficient evidence establishes intentional manipulation.
A banned person may submit one appeal, limited to factual error, mistaken identity, compromised-account circumstances, materially incorrect evidence, or another material error in the finding. The appeal challenges the factual finding; it is not a request for forgiveness or a second chance. Passage of time, good behavior, apology, or a request for reinstatement does not create a right to return. If the finding is upheld, the permanent ban remains. Gambit Gamer retains discretion to reconsider a finding if genuinely new and material evidence later emerges; this discretion creates no right to reconsideration.
9.6 Falsifying Information
You may not falsify or materially misrepresent identity, age, residency, eligibility, verification information, prize-claim information, or other information Gambit Gamer reasonably requires for account, Competition, or legal compliance purposes. Falsification is an ordinary violation unless it is itself part of intentional manipulation under 9.4.
9.7 Technical Errors
Encountering, discovering, reproducing for legitimate reporting purposes, or reporting a technical error is not a violation — please report errors to support@gambitgamer.com. You may not knowingly exploit a technical error to obtain an unauthorized advantage or anything you are not entitled to, to manipulate Competition activity, to interfere with another user, to disrupt Gambit Gamer, or to otherwise misuse the error.
9.8 Automated Access and Security
You may not: access the platform through unauthorized automated means or scrape it; bypass or circumvent security measures, access controls, or technical restrictions; access systems, accounts, data, or services without authorization; or disrupt or interfere with Gambit Gamer systems or services. Reverse engineering is prohibited except to the extent applicable law expressly permits it. Legitimate ordinary use of the platform is never a violation of this section.
9.9 Harassment and Unlawful Conduct
Harassment, credible threats, targeted abuse, doxxing, and unlawful conduct are prohibited. Criticism, disagreement, trash talk, satire, and negative opinions are not violations by themselves — Gambit Gamer is not a civility-policing platform.
Lawful criticism of Gambit Gamer, its rules, GPUs, employees, products, services, or decisions is not prohibited merely because it is negative, unpopular, offensive, or critical. This protection does not extend to conduct that independently involves threats, harassment, doxxing, impersonation, privacy violations, manipulation, or another violation of these Terms.
9.10 Usernames
A username may not:
- impersonate another person, a GPU, Gambit Gamer, or another organization;
- falsely imply affiliation with or endorsement by Gambit Gamer;
- contain threats, targeted harassment, hate speech, or unlawful content;
- include another person’s private or sensitive information;
- be used to evade a suspension, ban, or other enforcement action; or
- otherwise violate these Terms.
We may require a username to be changed, or remove one that violates these rules. Impersonation of Gambit Gamer, GPUs, personnel, or official accounts is treated especially seriously because of fraud and scam risk. Clearly non-deceptive parody, satire, or commentary is not impersonation merely because it references Gambit Gamer, a GPU, an employee, or another public identity — the test is deception, not flattery. Profanity, edgy humor, or unusual usernames are not violations on taste grounds alone.
10. Streams and Content
Gambit Gamer displays and references live streams and related content produced by GPUs. GPU streams are the property and responsibility of their creators and platforms; we do not control their content or availability.
Your username, GGX, ranks, Classes, titles, Cache showcase, and Competition results are public by design and may appear on leaderboards, ceremony replays, winner histories, and live displays, identified by username only.
11. Our Property
Gambit Gamer — including its software, design, names, logos, and content — belongs to Gambit Gamer, Inc. or its licensors. We grant you a limited, non-exclusive, revocable license to use the platform as intended. Feedback you send us may be used without obligation.
12. Account Deletion and Data
You may delete your account and request an export of your data. Deletion anonymizes your public profile; audit, ledger, prize, and tax records are retained as required for integrity and by law. Details are in the Privacy Policy.
13. Enforcement; Termination
You may stop using Gambit Gamer at any time.
For ordinary violations of these Terms or the Official Rules, we use proportionate corrective measures, which may include warnings, restrictions, suspension, voiding affected activity, correcting GGS or GGX, removing Leaderboard or Class eligibility, revoking prize eligibility or a Vault Key, disqualifying affected activity, or account termination. Corrective action is generally limited to the affected activity where reasonably possible — except confirmed intentional manipulation, which is governed by the zero-tolerance rule in Section 9.4.
Gambit Gamer will not take enforcement action solely because lawful expression is unpopular, offensive, critical, negative, or contrary to another user’s preferences. This does not limit enforcement where the expression independently involves threats, harassment, doxxing, fraud, impersonation, unlawful conduct, manipulation, security abuse, or another violation of these Terms.
Virtual items carry no value on suspension or termination.
Reservation of rights. A suspension, disqualification, termination, permanent ban, or other enforcement action does not waive or limit any other right or remedy available to Gambit Gamer, Inc. Where appropriate, Gambit Gamer, Inc. may pursue any civil, equitable, contractual, statutory, or other remedy available under applicable law — including for fraud, intentional manipulation, unauthorized access, interference with our systems, misuse of confidential or proprietary information, unlawful conduct, threats, or conduct causing or threatening material harm to Gambit Gamer, Inc., users, GPUs, personnel, partners, or systems — and may refer matters to law enforcement, regulators, service providers, or other appropriate authorities. Platform enforcement is not a substitute for, and does not exhaust, legal remedies.
14. Disclaimers
Gambit Gamer and its services are provided “as is” and “as available.” To the fullest extent permitted by applicable law, Gambit Gamer, Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that Gambit Gamer will always be available, uninterrupted, secure, or error-free. Live streams and certain other services depend on third parties and may become unavailable, interrupted, changed, or discontinued without notice.
Nothing in these Terms excludes any warranty, right, or protection that cannot lawfully be excluded.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Gambit Gamer, Inc. and its officers, directors, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity, arising from or relating to your use of Gambit Gamer.
To the fullest extent permitted by applicable law, Gambit Gamer, Inc.’s aggregate liability arising from or relating to the platform or these Terms will not exceed $100.
These limitations do not apply where liability cannot lawfully be limited or excluded.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a lawsuit, you and Gambit Gamer agree to make a reasonable, good-faith effort to resolve the dispute informally by contacting support@gambitgamer.com.
Any dispute not resolved informally will be brought in a court of competent jurisdiction in California, except where applicable law gives you the right to bring a claim elsewhere. Nothing in this section prevents either party from seeking emergency, temporary, or injunctive relief where appropriate.
17. Changes
We may update these Terms. Material changes will be announced, and continued use after the effective date is acceptance. The Terms in effect when a Season opens govern that Season's Competition matters together with the Official Rules; consistent with the Official Rules, a mid-Season change is made only when reasonably necessary to address a serious fairness issue, technical failure, fraud, security issue, legal requirement, or another circumstance materially threatening Competition integrity, and is limited to what that issue requires.
